personal injury Animal Bites

In many households throughout the United States, animals aren't just pets, they're members of the family. However, it's important to remember that all animals are still capable of attacking and inflicting injuries on others - many of these victims are children. VanDette Law PLLC is your dedicated partner when it comes to personal injury cases involving animal bites, particularly dog attacks. We recognize the gravity of such incidents and understand the physical and emotional toll they can exact.

Do not underestimate the seriousness of a animal attack

Many people think of domestic pets as harmless, but that's not always the case. The potential consequences of a bite or attack are serious and can include:

  • Tissue damage to the arms, legs, and face
  • Infection
  • Significant pain
  • Permanent disfigurement
  • Partial or total blindless (if bitten in the face)
  • Post-traumatic stress disorder and other psychological injuries

New York's Liability Laws

Each state takes its own approach to the liability of dog owners after a dog bite or attack. In some states, dog owners are only liable if they knew that their dog was aggressive and has displayed similar behavior in the past. This is commonly referred to as the "one-bite rule". In other states, dog owners are strictly liable, meaning they assume liability just by owning the dog.

New York's Liability Laws are a hybrid of these two principles. Dog owners are strictly liable for the victim's medical bills and/or veterinary costs (if the victim was another animal such as a guide dog or domestic pet). If the victim wishes to pursue other damages such as pain and suffering, they will need to prove that the owner knew or should have known that their dog was aggressive or vicious.
